According to the Notification of the Ministry of Agriculture and Farmers Welfare, Department of Agriculture, Cooperation and Farmers Welfare on the 31st January, 2020 in New Delhi:
Whereas the Central Government, in pursuance of the orders of Hon’ble Supreme Court of India in its judgment in the case of Writ Petition No. 1094 of 1988 filed by Dr. Ashok vs. Union of India and others, constituted an Inter Ministerial Committee to review the use of insecticides and hazardous chemicals;
Whereas the Inter Ministerial Committee, in a meeting held on 8th January, 2019 and 10th October, 2019 has discussed and reviewed the use of Tricyclazole and Buprofezin. It has been further decided to revisit the usefulness, efficacy and safety of the Tricyclazole and Buprofezin in a holistic manner keeping in view the maximum residue limit fixed by European Union in respect of said insecticides on rice crop;
And whereas the Central Government, after considering the views expressed by the said Inter Ministerial Committee, is of the opinion that the use of Tricyclazole and Buprofezin involves health hazards to human beings, animals and the environment.
The Draft Order, which the Central Government proposes to make, is hereby published for information of all persons likely to be affected thereby; and notice is hereby given that the said Draft Order shall be taken into consideration after expiry of a period of thirty days from the date on which the copies of the Gazette of India containing the Order are made available to the public.Any suggestion or objection in respect of the said Draft Order may be forwarded to the Central Government within the period so specified to the Joint Secretary (Plant Protection), Ministry of Agriculture and Farmers Welfare, Department of Agriculture, Cooperation and Farmers Welfare, Krishi Bhavan, New Delhi-110001.
Now, therefore, in exercise of the powers conferred by sub-section (2) of section 27 read with section 28 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby proposes to makes the following Order, namely:
1. Short title and commencement(1) This Order may be called the Insecticides (Prohibition) Order, 2020
